Terms and Conditions of Use

By accessing or using ParkPool ("the Service" or "the Platform"), operated by Fixit Group LLC ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). The use of ParkPool services implies full and unconditional acceptance of these Terms and Conditions by Valet Parking Companies and end users.

MVP - B2B Operation: SaaS platform for reservation management, queues, personnel, and payments. Future Phases - B2C Operation: Direct interface with end user, including autonomous requests, payment history, additional services, and Fixit ecosystem.

Responsibility begins only when the vehicle is formally received and the digital entry ticket is generated. Incidents occurring in the waiting line before check-in are not the responsibility of ParkPool or the Operator. The user grants a tacit mandate when handing over the keys, authorizing the Valet to drive and safeguard the vehicle. Custody ends when the vehicle is delivered and marked as "Checked Out" in the system.

The Valet must capture at least two photographs of the vehicle at check-in. These images constitute legal evidence in case of claims for pre-existing damage or scratches. The user accepts that this evidence takes precedence over subsequent claims without additional support.

Rates are defined by the Valet Company and configured in the system. The user accepts the rates before making the payment, which is made through a digital link (e.g., Stripe). Additional payments for complementary services (washing, charging, assistance) will be previously informed and accepted. ParkPool is not responsible for failures in external payment gateways.

ParkPool is not responsible for damages derived from force majeure, user negligence, or incidents outside the custody period. In future services such as "Designated Driver" or "Valet On-Demand", extra-contractual civil liability will be covered by specific insurance policies. ParkPool does not guarantee continuous service availability, being able to suspend it for maintenance or updates.

Provide truthful and complete information about the vehicle. Do not deliver vehicles with serious mechanical failures that may put the operation at risk. Comply with safety and coexistence rules in service areas.

Train their personnel in the correct use of the platform. Ensure the veracity of the information registered in the system. Comply with labor and safety regulations applicable to operational personnel.

ParkPool collects and retains data such as license plate, name, and phone number of the user. The user expressly authorizes the use of their data for cross-commercial purposes with Fixit ecosystem partners (insurance, maintenance, roadside assistance). Data may be retained as "qualified leads" even after the service has ended. Profile enrichment will be applied for marketing segmentation, always within the legal limits of the Florida Information Protection Act (FIPA) and other applicable privacy laws in the U.S. The user may exercise their rights of access, rectification, and deletion of data in accordance with current Florida legislation.

All software, trademarks, and content associated with ParkPool are the exclusive property of the company and may not be reproduced without authorization.

ParkPool may update these Terms and Conditions at any time, notifying clients and users. Continued use of the service implies acceptance of the modifications.

These Terms and Conditions are governed by the laws of the State of Florida, United States of America. Any dispute shall be resolved before the competent state or federal courts located in Miami-Dade County, Florida. The user and the Client expressly waive any other jurisdiction that may correspond to them.
